These Terms of Service ("Terms") govern your access to and use of the Viralcue platform and services operated by Viralcue ("we," "our," or "us"). Please read these Terms carefully before using our services.

1. Acceptance of Terms

By accessing or using Viralcue at viralcue.io or any related services, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access or use our services. If you are using Viralcue on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Service Description

Viralcue is an AI-powered software-as-a-service (SaaS) platform that provides video analytics and content creation tools for short-form content creators. Our services include:

  • AI Virality Scorecard: 5-dimension scoring and analysis of video content from Instagram Reels, YouTube Shorts, and TikTok
  • Creator DNA: Voice fingerprinting that analyzes your content to extract your unique speaking patterns, vocabulary, and style
  • Script Studio: AI-generated scripts matched to your Creator DNA voice profile
  • Competitor Tracking: Analytics and comparison tools for monitoring competitor content
  • Transcription: AI-powered video transcription with timestamps
  • Idea Bank: AI-generated content ideas with virality scoring
  • Instagram Growth Tracking: Follower and engagement analytics for connected Instagram accounts

3. Account Registration

To use Viralcue, you must create an account. You agree to:

  • Be at least 16 years of age
  • Provide accurate and complete registration information
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Subscriptions and Billing

Viralcue offers the following subscription tiers:

Free ($0/month)

  • 3 video analyses per month
  • AI Virality Scorecard with improvement feedback
  • Creator DNA Preview
  • 1 competitor tracker, 1 comparison per month, 1 scrape per month
  • 3 transcriptions per month
  • Idea Bank (1 batch per week)

Pro ($39/month or $31/month billed annually)

  • 15 video analyses per month
  • Full Creator DNA Analysis
  • Voice-Matched Script Studio (20 operations per month)
  • 5 competitor trackers, 10 comparisons per month, 1 scrape per day
  • 30 transcriptions per month
  • Idea Bank (1 batch per day)

Creator Max ($99/month or $79/month billed annually)

  • 50 video analyses per month
  • Full Creator DNA Analysis
  • Voice-Matched Script Studio (50 operations per month)
  • 10 competitor trackers, 30 comparisons per month, 1 scrape per day
  • 100 transcriptions per month
  • Idea Bank (1 batch per day)

Billing Terms

All paid subscriptions are processed through Stripe. By subscribing to a paid plan, you authorize us to charge the applicable fees to your payment method on a recurring basis. Subscriptions automatically renew at the end of each billing period unless cancelled.

You may cancel your subscription at any time. Upon cancellation, you will retain access to your paid features until the end of the current billing period. We do not provide refunds for partial billing periods.

We reserve the right to change our pricing with 30 days' advance notice. Price changes will take effect at the start of your next billing cycle.

5. Acceptable Use

You agree not to:

  • Upload or submit video content that you do not own or have the right to analyze
  • Use the platform for harassment, spam, or any illegal purpose
  • Attempt to reverse-engineer, decompile, or extract our AI models, algorithms, or scoring systems
  • Automate access to the platform beyond the provided interface, or circumvent rate limits
  • Share, resell, or sublicense your account access to third parties
  • Interfere with or disrupt the integrity or performance of the platform
  • Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable

6. Intellectual Property

Our property: Viralcue, including the platform, AI models, scoring algorithms, user interface, and all associated intellectual property, is owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of our platform.

Your content: You retain full ownership of any video content you upload or submit for analysis. You also retain ownership of scripts generated through Script Studio and your Creator DNA profile.

Aggregated data: We retain the right to use aggregated, anonymized analytical data (which cannot be used to identify you) to improve our services and AI models.

7. AI-Generated Content

Viralcue uses AI to generate analyses, scores, scripts, ideas, and recommendations. You acknowledge and agree that:

  • AI-generated outputs are provided as suggestions and guidance only — they do not guarantee specific results, virality, or audience growth
  • You are solely responsible for reviewing, editing, and publishing any AI-generated content
  • AI outputs may not be unique and similar content may be generated for other users
  • Virality Scorecards and analyses represent AI-informed assessments, not guarantees of performance

8. Competitor Tracking

Our competitor tracking features collect and analyze publicly available data from public social media profiles. By using these features, you acknowledge that:

  • Only publicly available information from public profiles is collected
  • You are responsible for ensuring your use of competitor data complies with applicable laws and the terms of service of the platforms being tracked
  • We do not guarantee the accuracy, completeness, or timeliness of competitor data

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We do not guarantee any specific results, virality, audience growth, or revenue from using our services. All AI analyses and recommendations are advisory in nature.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRALCUE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Termination

You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your access to the platform immediately if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the platform or other users.

Upon termination, your right to use the platform ceases immediately. You may request deletion of your data following termination by contacting us at support@viralcue.io.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes by posting the updated Terms on this page and, where appropriate, notifying you via email. Continued use of the platform after the effective date of revised Terms constitutes your acceptance of the changes.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Viralcue is established, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.
